SecretSpots is a marketplace that connects travelers with local guides for personalized tour experiences. We facilitate bookings but are not responsible for the conduct of guides or travelers.

2. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3. Guide Terms

If you register as a guide on our Platform, you agree to:

• Provide accurate information about your qualifications and experience
• Maintain all required licenses and permits for guiding services in your area
• Honor all confirmed bookings or provide adequate notice for cancellations
• Provide a safe and professional experience for all travelers
• Comply with all local laws and regulations

4. Commission Structure

SecretSpots charges guides a commission on each completed booking. Our commission structure is designed to encourage guides to accommodate larger groups:

Group Size Cap Policy

If you set a maximum group size limit on your profile, your base commission rate will be adjusted accordingly. This ensures guides who accept larger groups benefit from lower rates:

• No group size limit (11+ people): Start at 0% commission
• Lower max group size: Higher base commission rate
• Max 1 person (private tours only): 30% commission on all bookings

5. Traveler Terms

When booking a guide through our Platform, you agree to:

• Provide accurate booking information including group size and preferences
• Arrive on time for scheduled tours
• Respect your guide and their expertise
• Follow all safety guidelines provided by your guide
• Pay the agreed-upon price for services rendered

6. Cancellations and Refunds

Cancellation policies may vary by guide. Please review the specific cancellation policy before booking.

• Traveler cancellations: Subject to the guide's cancellation policy
• Guide cancellations: Full refund to the traveler
• Weather or emergency: Handled on a case-by-case basis

7. Prohibited Activities

You may not use the Platform for:

• Any illegal or unauthorized purpose
• Harassment, abuse, or harm to others
• Posting false, misleading, or fraudulent content
• Circumventing the Platform to avoid commission payments
• Impersonating another person or entity
• Collecting data about other users without consent

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by SecretSpots and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

SecretSpots is a marketplace platform and is not responsible for:

• The quality, safety, or legality of guide services
• The truth or accuracy of user-generated content
• The ability of guides to provide services
• The ability of travelers to pay for services
• Any disputes between users

In no event shall SecretSpots be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

10. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable laws.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the Platform with an updated "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
